1. Scope
These terms and conditions apply to the use of Cher Petit at cherpetit.com and to every book and every copy you order from us. Cher Petit is operated by Andy Flury, Buckhauserstrasse 1, 8048 Zürich, Switzerland ("we").
Cher Petit is for private individuals in Switzerland. We deliver only to addresses in Switzerland.
The German version of these terms is binding; the English version is a translation.
2. Account and family
You sign in with Google or with a sign-in link we send you by email. An account belongs to one person with one verified email address. To open an account and order books, you must be of age.
Each account is one parent of a family. The family owns its books, people, places, photos, drawings and orders. You bring in another parent with an invite link. Every parent sees everything the family owns and can work on every book, order, pay and delete the family. Invite only people you trust with that.
Before you use Cher Petit, you accept these terms. Keep your access to your Google account and to your email address protected; whoever signs in with it acts for your account.
3. The contract
The questions on cards, the book's style, the drawing of the main character and the story proposals are free and non-binding. The comic portrait of your child that you approved is yours to keep and to share, even if you do not buy the book.
The contract for a book is made when you pay for it. You can pay once you have chosen the story; only then is the book drawn further. The contract for further copies is made when you order and pay for them.
A paid book stays open without a time limit until you finish it.
4. Prices and payment
- A family's first book costs CHF 99. Every further book costs CHF 79 if the family already has a paid book when that book is created.
- A book's price is set when you create the book and does not change afterwards.
- A book's price includes one printed copy. Each further copy costs CHF 49: up to nine with the book's first order, later one to ten per order.
- All prices are in Swiss francs and include delivery within Switzerland. We are not registered for VAT and charge no VAT.
- You pay through Payrexx with the payment methods offered there. We receive no card or account details. Payrexx sends you the confirmation of your payment.
Vouchers. A voucher is for a whole book or for an amount off a book. It is valid for one year from its issue, is redeemed once on the payment of a book and does not apply to copies. Value above the book's price lapses and is not paid out. If less than CHF 0.50 remains to pay after the voucher, we waive it. A redeemed voucher stays redeemed even if the book's payment is refunded later.
Refunds are made by us alone. If the payment of a book is refunded, the book counts as unpaid again and work on it stops. Once a print order of a book has been placed, its price is no longer refunded.
5. How the book is made
You answer our questions on cards and then talk with an AI. It asks what the cards left open, proposes stories, writes the page plan and the text and draws the pictures from your photos and details. What the AI does and which provider we use is in the AI notice.
The book is made in steps: your answers on the cards with the style you choose, the main character's portrait, the story, further characters, places and objects, page plan and text, pages, cover and proof. Each step from the portrait on ends with your approval. Only you approve, and you decide when something is good enough. What you have approved holds for this book: characters, title, dedication and language are fixed by their approval, and later adjustments are made on the pages.
Change requests. Each book includes 20 change requests. A change you ask for costs one change request per picture it concerns, at the moment you ask for it, even when it fixes a mistake of the AI. If the change requests left do not cover the whole change, it is not carried out. Free of charge are: a choice among offered variants, an approval, changes to texts before they are drawn, and every correction the AI makes on its own. We may grant you further change requests on request; they are not sold and have no cash value.
AI pictures are not flawless. Faults that cannot be fixed are named to you by the AI before you approve. Nothing is printed until you have approved the proof. That last approval is final: after it, the book is no longer changed.
6. Your photos and content
Upload only photos you may use. Before a person's first photo, you confirm that you may use photos of this person and share them with families you choose. Where a photo shows neither you nor your own child, that means: the person agrees, or for a child, its parents.
You are responsible for the photos and details you give us. They must not infringe anyone else's rights and must contain nothing unlawful, hurtful or demeaning.
We use your photos and details only to make, print and deliver your family's books. We do not train any AI with them and never use a person's likeness for our own purposes, such as samples or advertising, except with your separate, explicit consent.
Sharing and handing over characters. Through a link you pass on yourself, you can share a drawn person or place with another family or hand it over to them. When you share, they receive the photos, the drawing and the profile — name, details, traits, age — and draw the character in their own books. You can withdraw the share; from then on they no longer receive the photos for new books, and a book already using the character keeps its drawings to its end. When you hand over, the character and its photos pass to the other family, and your family keeps the right to go on using the drawing. Share or hand over a character only if the person shown, or for a child its parents, agrees.
Rights in the pictures. Under current understanding, no copyright exists in pictures made by an AI; we therefore promise you none. You may use your book and its pictures, the comic portrait included, freely in private and share them with family and friends.
The AI provider may refuse a picture under its safety rules. The AI then tells you why and proposes another way.
7. Printing and delivery
After the last approval, you order the book in the conversation with the delivery address and any further copies. You can order further copies later at any time. The book is printed as a 21 × 28 cm hardcover by our print partner Gelato, for orders from Switzerland as a rule in Switzerland.
An order is one parcel to one address in Switzerland, sent with tracking. We use the address you confirm with the order; please check it carefully.
You see the status of your order in the app, and once the parcel is on its way we send you an email with the tracking. Delivery dates are estimates of the print partner or the carrier and are not binding. If an order fails, we contact you in person.
8. No right of withdrawal
Every book is made for you to your own specification. There is therefore no right of withdrawal or return. Until you pay for a book, you can stop at any time and delete the unpaid book yourself.
If a book arrives with a printing defect or damaged, please write to us promptly after receipt at support@cherpetit.com, with a photo of the fault. We have it reprinted and delivered free of charge. What you approved — texts and pictures, including their AI faults — is not a defect. Any further warranty is excluded as far as the law permits.
9. Retention and deletion
Your family's data stays stored until you delete it. You can delete an unpaid book yourself at any time, and likewise your account and your family, at once and for good. We delete an unpaid book with no activity for 12 months, and a family in which nobody has signed in for 3 years together with all its books; in both cases we remind you by email 30 days before. What we keep and for how long is in the privacy policy.
We do our best to keep Cher Petit available but cannot guarantee it; the AI may at times be at capacity or unreachable. If someone breaches these terms, we may block their account.
10. Liability
We are liable without limit for damage we cause intentionally or through gross negligence. Otherwise our liability is excluded as far as the law permits, in particular for indirect and consequential damage, for content you approved, and for delays of the print partner or the carrier. Any mandatory statutory liability, such as under the Product Liability Act, remains reserved.
If you use photos or details without being entitled to, and someone makes claims against us because of it, you are liable to us for them.
11. Changes to these terms
If we change these terms, we show you the new version at your next sign-in, and you continue using Cher Petit once you have accepted it. If you do not want to accept it, you can download your data and delete your account. The price and the change requests of an existing book stay as they were set when it was created.
12. Applicable law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zürich; the mandatory place of jurisdiction at your domicile as a consumer remains reserved.
